The Graduate Program in Law at the University Estacio de Sa, recognized by CAPES with grade 5, aims to: - encourage legal research, dogmatic and interdisciplinary studies with other knowledge as a formative base of critical legal knowledge; - Train researchers able to understand the legal system in its relationship with the surrounding reality, especially with other branches of knowledge; - Train teachers able to understand and thus question the legal phenomenon in its various dimensions in order to enable them to find solutions to the issues at stake; - Prepare students able to work for the advancement of research, teaching in Brazil, offering contributions on the world stage.
Concentration area: PUBLIC LAW AND SOCIAL DEVELOPMENT
The area of concentration has as its guiding principle the Constitutional Law, the Constitutional Theory, the Theory of Fundamental Rights and the Philosophy of Law. This is matrix that integrates the two lines of research. Promotes joint investigation of procedural law and dimensions of the material and thus of fundamental rights, based on an interdisciplinary structure / transdisciplinary, open, reflective.
Research, contemporary setting, commonly referred to as post-positivist, although it proposes to also be post-natural law, the search for overcoming classic stir among juspositivismo and natural law, a third way. Then dealing with the contemporary doctrine of democracy, the historicity of law, the rights basis and, in this step, the Constitution itself, and also the mainstay of hermeneutics study.
All this without disregarding dogmatic, operational, instrumental elements, so as to identify the limits and possibilities of law, the relationship between fact and norm, between text and context, the problem of language, the legitimacy of the official institutions and the insurgency of new rights , arrangements, chat channels and statement of understanding.
